Welcome to AskCappy. These Terms of Use (“Terms”) are the rules for using askcappy.com and its newsletter, forms and tool directory (together, the “Site”). “AskCappy”, “we”, “us” and “our” mean the team that runs the Site.
By using the Site, you agree to these Terms, our Privacy Policy and our Disclaimer. If you don’t agree, please don’t use the Site. You must be at least 18 years old to create an account, post content or submit a tool.
1. Using AskCappy
You’re welcome to read, share and link to our content for personal and business research. When using the Site, you agree not to:
- copy, republish or sell our articles, reviews, scores or images without written permission (short quotes with a link back to the original page are fine);
- scrape, crawl or bulk-download the Site or its tool directory with automated tools, except for search engines indexing it;
- post or submit anything illegal, misleading, hateful, harassing, sexually explicit or infringing someone else’s rights;
- post fake reviews, review your own product without saying so, or try to manipulate ratings;
- send spam, malware or anything that could harm the Site or its visitors;
- try to hack, overload or get unauthorized access to the Site or its systems.
2. Our content, trademarks and copyright
The AskCappy name, logo, speech-bubble design, Cappy Score, Cappy’s Pick, Cappy Approved badge and all original articles, reviews, graphics and screenshots on the Site belong to AskCappy and are protected by copyright and trademark laws.
Product names, logos and trademarks of other companies belong to their owners. We use them only to identify and review their products, and this doesn’t mean those companies endorse AskCappy.
Copyright concerns: if you believe content on the Site infringes your copyright, email hello@askcappy.com with the subject “Copyright notice”. Include the page link, a description of your work and proof that you own it, and we’ll review it promptly.
3. Accounts, reviews, comments and tool submissions
Your account: keep your login details safe. You’re responsible for anything done through your account.
Your content: you keep ownership of the reviews, comments, questions and submissions you send us. By posting or sending them, you give AskCappy a free, worldwide, non-exclusive right to display, edit for length or clarity, translate and share them on the Site, in our newsletter and on our social channels.
Honest reviews only: user reviews must be based on your real experience. If you work for, or are paid by, the company behind a tool, you must say so.
Tool submissions: submitting a tool doesn’t guarantee it will be listed. We decide what to list, how to describe it and where it appears. Paid listings or featured spots, if we offer them, will always be clearly labelled and never change our Cappy Score or Cappy’s Pick.
We may remove any content, or suspend any account, that breaks these Terms.
4. Affiliate links, ads and third-party sites
Some links on the Site are affiliate links, and some pages show ads. We may earn money when you click or buy, at no extra cost to you. See our Affiliate Disclosure for details.
When you buy or sign up for a tool through a link on AskCappy, your agreement is with that company, not with us. We don’t control third-party websites or software and aren’t responsible for their content, pricing, privacy practices, security or support.
5. No warranties and limitation of liability
The Site and its content are provided “as is” and “as available”. We work hard to keep our reviews accurate and current, but software features and prices change often, and we can’t guarantee that everything on the Site is complete, correct or up to date. Always check details with the software company before you buy.
To the fullest extent the law allows, AskCappy is not liable for any indirect, incidental or consequential losses, including lost profits, lost data or business interruption, that come from using the Site or any tool we review.
Some countries don’t allow these limits, so they may not fully apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can’t be waived.
6. Indemnity
If you break these Terms or post content that infringes someone’s rights, and that leads to a claim against AskCappy, you agree to cover the reasonable costs and losses that result.
7. Suspension and termination
We may limit, suspend or end your access to the Site, or remove your content, if you break these Terms or misuse the Site. We may also change or discontinue any part of the Site at any time.
8. Changes to these Terms
We may update these Terms from time to time. We’ll post the new version on this page and change the effective date. If you keep using the Site after an update, you accept the new Terms.
9. Governing law
These Terms are governed by the laws of India. Any dispute will be handled by the courts of India, unless the law of your country gives you the right to bring a claim where you live.
